1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the ForemanForge application ("the Service"), operated by ForemanForge LLC, a Georgia limited liability company ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

ForemanForge provides educational and exam-preparation content for fire sprinkler system certification, including practice questions, lessons, and progress tracking. The Service is provided for informational and educational purposes only. We make no guarantee or warranty, express or implied, that completion of any lesson, quiz, or practice exam will result in passing the NICET certification exam or any other certification.

3. No Affiliation or Endorsement; No Guarantee of Passing

ForemanForge is not affiliated with, endorsed by, or sponsored by the National Institute for Certification in Engineering Technologies (NICET) or the National Fire Protection Association (NFPA). All NICET and NFPA names, trademarks, and exam content are the property of their respective owners. References to these organizations are for educational purposes only. ForemanForge does not guarantee that any user will pass any certification exam, including but not limited to NICET exams. Your results depend on your own study effort, experience, and examination performance.

4. User Accounts

To access certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when registering and to update your information as needed. You must be at least 18 years old to create an account.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
• Share, transfer, or sell your account credentials to others.
• Use automated systems (bots, scrapers) to access or collect content from the Service.
• Interfere with or disrupt the Service or servers used to deliver it.

6. Intellectual Property

All content provided through the Service — including lessons, questions, explanations, diagrams, graphics, and software — is the copyrighted property of ForemanForge LLC. You may not copy, reproduce, redistribute, republish, download, transmit, or modify any content from the Service without our prior written consent. You may print or download content solely for your personal, non-commercial study use.

7. Subscriptions and Billing

The Service offers paid subscription plans ("Pro" and "Founding Member"). By purchasing a subscription, you agree to the following terms:

• Auto-renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or annually, depending on your plan) unless you cancel before the renewal date. You authorize us (or the applicable app store) to charge the then-current subscription fee to your payment method on file.
• Cancellation: You may cancel your subscription at any time through your account settings or the applicable app store. Cancellation takes effect at the end of your current billing period — you will retain access to Pro features until that date, and no further charges will be made.
• Price changes: We may change subscription fees upon reasonable notice. If the fee increases, you may cancel before the new rate takes effect. If you do not cancel, you authorize the new charge at the updated rate. Price-change notice will be provided via email or in-app notification at least 30 days before the effective date.

8. Refund Policy

If you purchased your subscription through the Apple App Store or Google Play Store, refunds are handled according to that store's refund policy, and you should contact the store directly.

For subscriptions purchased directly through the ForemanForge website, you may request a full refund within 7 days of purchase, provided that you have consumed less than 20% of the paid content (as measured by lessons completed, practice exams taken, or CEU courses accessed). To request a refund, email us at info@foremanforge.com with your account email and order details. Refunds are processed to the original payment method within a reasonable timeframe.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that the content is accurate, complete, or current. Your use of the Service is at your sole risk.

10. Limitation of Liability

To the fullest extent permitted by law, ForemanForge LLC shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages arising from your use of or inability to use the Service, including but not limited to damages for loss of profits, data, or other intangible losses, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify and hold harmless ForemanForge LLC and its officers, employees, and agents from any claim or demand arising out of your use of the Service or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States of America, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in the State of Georgia.

13. Changes to These Terms

We may update these Terms from time to time. We will notify users of significant changes through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
